On August 7, 2025, President Donald Trump signed a new executive order directing U.S. financial regulators to revise rules around 401(k) retirement accounts. The order signals growing momentum in Washington to modernize retirement investing and expand access to assets beyond traditional stocks and bonds.
What the Executive Order Does
The executive order instructs the Securities and Exchange Commission (SEC), Department of Labor (DOL), and Treasury Department to coordinate on regulatory updates that would permit defined-contribution retirement plans, such as 401(k)s, to offer broader investment options.
This would include:
- Digital assets like cryptocurrency
- Private equity and credit
- Real estate investment vehicles
The directive builds on earlier Department of Labor guidance from 2020 that allowed limited exposure to private equity in 401(k) plans. However, adoption was minimal due to concerns around complexity and legal liability. But the new order aims to revisit and simplify those pathways. President Trump’s new executive order may eventually expand investment options inside 401(k) plans, but that process could take time. Regulatory agencies still need to evaluate the rules, coordinate across departments, and address legal and fiduciary concerns.
